If all possible negotiations can be done without going before a judge then this could save a lot of time and money – although it might mean that your case is resolved faster, the final figure you receive might be smaller. On the other hand, if your lawyer manages to win in court then they will most likely be able to claim their expenses from the opposing side; these could include filing fees and legal research costs.
